Back Yard Burgers, Inc., incorporated in
December 1986, operates and franchises quick-service and fast-casual restaurants
across 17 states. The Company's restaurants specialize in charbroiled, freshly
prepared, great tasting food. The Company's menu features made-to-order gourmet
100% Black Angus hamburgers and chicken sandwiches, which are charbroiled over
an open flame, fresh salads, chili and other special entrees as well as
hand-dipped milkshakes, fresh-made lemonade and fresh-baked cobblers. As of
December 29, 2001, Back Yard Burgers' operations included 37 Company-operated
restaurants and 67 franchised restaurants.
At December 29, 2001, Back Yard Burgers had 25 Company-operated restaurants in
Memphis, Tennessee; seven in Little Rock, Arkansas; and five in Nashville,
Tennessee. At December 29, 2001, the Company had nine franchised restaurants in
Kansas City, Missouri; four each in Birmingham, Alabama and Knoxville,
Tennessee; three each in Fayetteville, North Carolina; Hickory, North Carolina;
Jackson, Mississippi and Orlando, Florida; two each in Akron, Ohio; Asheville,
North Carolina; Chattanooga, Tennessee; Evansville, Indiana; Greenville, South
Carolina; Lexington, Kentucky; Little Rock, Arkansas; Marietta, Georgia;
Memphis, Tennessee and Tulsa, Oklahoma.
In addition, the Company has franchised restaurants in what it categorize as
Other Markets. Other markets for the restaurants range from small towns to large
cities where franchisees have only one restaurant. These markets and their
number of franchised restaurants are the following: Mississippi (5), Arkansas
(2), Kentucky (2), Missouri (2), Georgia (1), Illinois (1), Indiana (1), Kansas
(1), Louisiana (1), North Carolina (1) and Texas (1).
The restaurants range in size from 820 square feet to 4000 square feet. The
restaurants also include Company-approved interior and exterior decor,
equipment, fixtures, furnishings, signs, parking and site improvements. The
restaurants have a highly visible, distinctive and uniform look that is intended
to appeal to customers of all ages.
The Company believes that its primary direct competitors are McDonald's, Burger
King and Wendy's.
